Per cba 1.8 all work associated with the Operations and Maintenance of the BART system belongs to SEIU (or ATU or one of the other BART Unions.)
When the District fails to notify us of their intent to contract out, we automatically win.
We've filed grievances, and have won monetary damages for our members. But we need YOU to be the eyes and ears of the Union. If you believe that contractors are doing work that belongs to SEIU, contact your Chief Steward to investigate.
With the help of our Contract Out Chair- Ron Rowell, we continue to challenge upcoming contracts, and to pressure the District to hire and plan our work accordingly.
Or rather the lack of any agreements. As many of you know, we had a TA- Tentative Agreement with the District to meet as soon as possible after negotiations to work on two separate agreements in regards to EBART and the OAC. <Click Here> for the TA on EBART and the OAC.)
In the meantime, the Operations and Maintenance of the OAC was contracted out for 20 years.
So where does this leave us????

On May 11th, Director Robert Raburn presented to the Chief Stewards Council and BART Board President Bob Franklin, Directors Gail Murray, and Tom Blalock took the presentation to all four RSS shops.

On June 18, 2010 as per cba 28.5B our members were paid a lump sum of $500 in lieu of a wage increase for FY2011.

Members on Workers Comp, and Short-term Disability were mistakenly NOT paid the lump sum.
A grievance was filed- and on Nov. 24, 2010 we reached a tentative agreement to settle the dispute.
Update- On Jan. 28, 2011 we signed a grievance resolution that settles the dispute. 35 of the 45 bargaining unit employees (who were not paid the lump sum) can expect the payment on their February 25th paycheck.
The next payment for FY12 is $1000, and will be added to your paycheck on July 15, 2011.
The payment for FY13 is $1500.
